DMCA & Copyright Policy

HogaToga respects the intellectual property rights of others and expects users and third parties to do the same. This page explains HogaToga’s own copyright in its content, how to report alleged copyright infringement, and what happens when a notice is received. This policy operates alongside our Terms of Service.

1. HogaToga’s Copyright

All original content published on hogatoga.com.co — including articles, reviews, tutorials, graphics, photographs, illustrations, and the selection and arrangement of content — is protected by copyright and is the property of HogaToga or its contributing authors. All rights are reserved unless otherwise stated.

You are welcome to quote brief excerpts from HogaToga articles (up to approximately 100 words) in your own content, provided you clearly attribute HogaToga and include a direct link to the original article. Wholesale republication of full articles — including republication on content-scraping sites or AI-training datasets — without prior written permission is a violation of our copyright and these Terms. To request a republication licence, email legal@hogatoga.com.co.

2. Reporting Copyright Infringement (DMCA Takedown Notice)

If you believe that content published on HogaToga infringes your copyright, you may submit a notice of claimed infringement pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512) or, for non-US rights holders, an equivalent notice under applicable law. To be valid, your written notice must include all of the following elements:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, including the title, URL, or other identifying information sufficient to locate it.
  2. Identification of the infringing material: A description of the material you claim is infringing and that you want removed or disabled, with enough detail for us to locate it — ideally including the specific URL(s) on hogatoga.com.co.
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. A statement of accuracy and authority: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  6. Your signature: A physical or electronic signature of the copyright owner or a person authorised to act on their behalf. Typing your full name in the email body is acceptable as an electronic signature.

Notices that are incomplete or do not meet these requirements may not be acted upon. Knowingly submitting a false notice may expose you to legal liability.

3. Where to Send the Notice

Send valid DMCA notices to our Designated Copyright Agent:

We will acknowledge receipt and respond within a reasonable time, typically within 10 business days. If the notice is valid, we will remove or disable access to the allegedly infringing material promptly while we investigate.

4. Counter-Notification

If you believe that material we removed or disabled in response to a DMCA notice was removed by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal courts in the district in which your address is located (or, if outside the US, any judicial district in which HogaToga may be found), and that you will accept service of process from the person who provided the original notice.

Send counter-notifications to legal@hogatoga.com.co with the subject line “DMCA Counter-Notification.” Upon receipt of a valid counter-notification, we will forward it to the original complainant and may reinstate the removed material after 10–14 business days, unless the complainant files a court action.

5. Repeat Infringer Policy

HogaToga has a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or participation privileges of users who are found to be repeat infringers of copyright. If you submit content to HogaToga — for example, via comments — and repeatedly violate third-party intellectual property rights, we will disable your ability to submit content and may take further action.

6. Fair Use and Quotation

We respect the doctrine of fair use (and equivalent doctrines in other jurisdictions, such as fair dealing). Before submitting a DMCA notice, please consider whether the use of your content on HogaToga may constitute fair use — for example, brief quotation for the purpose of commentary, criticism, or news reporting. We welcome quotation of our own content with proper attribution and linking, and we extend the same expectation to our own use of others’ material.
